In June of 2018, the Kansas state regulators legalized CBD for sale, distribution and use in the State of Kansas. They lobby for CBD legalization felt they had won a victory, and rightfully so.
Even though the Farm Bill of 2014 had legalized Industrial Hemp, it never specifically legalized CBD. Consequently, CBD was illegal according to the Kansas State Government. Understandably this frustrated local advocates for hemp and CBD oil.
In 2018, the second federal farm bill went through clarifying that CBD Oil was legal in the United States. Shortly thereafter, the Kansas State Government clarified the rules on CBD oil and implicitly recognized it as legal for sale and use in Kansas. What was still in contention was whether they meant Full Spectrum CBD which contains all the cannabinoids hemp has to offer, including THC, or Tetrahydrocannabinol, the compound that gets people high when consuming marijuana.
Confusion On CBD In Kansas
Here’s where the confusion comes in. The Kansas Legislature voted at the end of April 2018 to exclude CBD with no THC from the state’s definition of marijuana, effectively making CBD oil not only legal, but more or less unrestricted for sale and use. Where the misunderstanding occurred is if the CBD can be full spectrum, which contains minimal amounts of THC, or if it must be CBD isolate, which is completely free of THC. Up until that time, many merchants were selling CBD products made with trace amounts of THC.
The decision handed down in clarification of CBD oil’s legal status made it clear; no CBD was legal in Kansas unless it contained zero THC.
However, this does not seem to have discouraged local vendors as multiple people inside the CBD industry confirmed that there were many vendors across Kansas who were selling full spectrum CBD. In fact, it seemed to be easily found all across the state as most people didn’t seem to realize it was supposed to be illegal.
Legal Clarification: CBD Oil Is Legal In Kansas
If you read the law it was very clear about the legal requirement for CBD Oil. However, things are changing in Kansas. In 2019, Kansas lawmakers passed two laws that relate to cannabis or its extracts.
One was the industrial hemp bill that some vendors believe now allows them to sell full-spectrum CBD with some THC.
The other was Claire and Lola’s law, a narrow bill that may assist certain people if they ever find themselves facing prosecution for possessing some products currently illegal in the state of Kansas.
